01. Acceptance of Terms

By accessing, browsing, or using the Machicrate platform (machicrate.com), including any services, features, content, or tools provided through the platform (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Machicrate ("we", "us", or "our"). By creating an account or using any part of the Service, you confirm that you are at least 13 years of age and have the legal capacity to enter into this agreement.

02. Platform Description & Third-Party Disclaimer

Machicrate is an independent, community-driven platform that provides tools and services for creating, managing, and distributing plugins for the city-building simulation game TheoTown.

Machicrate operates as an independent third-party tool that works alongside TheoTown's plugin ecosystem. Use of the Machicrate platform does not grant you any rights or licenses to TheoTown's intellectual property.

03. User Accounts

To access certain features of the Service, you must register for an account. When creating an account, you agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information to keep it accurate and current.
• Maintain the security and confidentiality of your login credentials.
• Accept full responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

Accounts are personal and non-transferable. You may not share, sell, or transfer your account to any other person. We reserve the right to suspend or terminate accounts that violate these Terms.

04. Subscriptions & Refund Policy

Machicrate offers subscription-based plans that grant access to premium features and tools. By subscribing to a paid plan, you agree to the following:

• Subscriptions automatically renew at the end of each billing cycle unless you cancel before the renewal date.
• You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.
• We reserve the right to change subscription pricing with 30 days' prior notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
• If your account is terminated due to a violation of these Terms, you will not be entitled to any refund for the remaining subscription period.

05. Revenue & Withdrawal

Machicrate allows plugin creators to earn revenue from the sale of their plugins through our plugin store. By participating in the revenue program, you agree to the following terms:

You are responsible for any tax obligations arising from revenue earned through the Machicrate platform. Machicrate does not provide tax advice and recommends consulting a tax professional for guidance related to your earnings.

06. User-Generated Content & Plugin Store

Machicrate allows users to create, upload, and distribute plugins and other user-generated content ("UGC") through our platform and plugin store. By submitting UGC to Machicrate, you represent, warrant, and agree to the following:

By publishing plugins on our store, you grant Machicrate a non-exclusive, worldwide license to host, display, distribute, and promote your content solely for the purpose of operating and improving the Service. You retain all ownership rights to your original content.

07. Intellectual Property & Copyright

The Machicrate platform, including its design, code, features, tools, branding, logos, and documentation, is the proprietary property of Machicrate and is protected by applicable intellectual property laws.

• Your Content: You retain all ownership rights to the original plugins, assets, and content you create using Machicrate.
• Our Platform: The Machicrate platform, including its source code, visual design, and tooling, remains our exclusive property.
• TheoTown IP: TheoTown, its name, logos, game assets, and all related intellectual property are owned exclusively by TheoTown and Blueflower GbR. Machicrate makes no claim to any TheoTown intellectual property.

If you believe that content on our platform infringes your copyright or intellectual property rights, please contact us with a detailed description of the alleged infringement, and we will investigate and take appropriate action.

08. TheoTown EULA Compliance

As Machicrate facilitates the creation of plugins for TheoTown, all users are expected to comply with TheoTown's official End User License Agreement. By using our platform, you acknowledge and agree that:

• Plugins created through Machicrate are intended for the desktop version of TheoTown, where modding is permitted under TheoTown's EULA.
• You will not use Machicrate to create modifications for the mobile version of TheoTown, as mobile modifications are prohibited under TheoTown's EULA.
• You will not use Machicrate to create content that circumvents game protections, bypasses security measures, or modifies core game mechanics.
• You will not use Machicrate to reverse-engineer, decompile, or disassemble any part of TheoTown.
• Distribution of plugins created with Machicrate must be for non-commercial purposes unless otherwise authorized by TheoTown's terms.

09. Prohibited Conduct

When using the Service, you agree not to:

• Violate any applicable laws, regulations, or third-party rights.
• Use the Service for any fraudulent, misleading, or deceptive purposes.
• Attempt to gain unauthorized access to any part of the Service or other users' accounts.
• Upload malicious code, viruses, or any content designed to disrupt the Service.
• Use automated bots, scrapers, or other tools to access the Service without our written consent.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Harass, abuse, or threaten other users of the platform.

10. Termination & Account Suspension

We reserve the right to suspend or permanently terminate your account and access to the Service at our sole discretion, with or without notice, for any reason, including but not limited to:

• Violation of these Terms of Service.
• Publishing UGC that infringes copyright, contains plagiarized content, or violates TheoTown's EULA.
• Engaging in prohibited conduct as outlined in Section 09.
• Any activity that we believe is harmful to the platform, other users, or third parties.

Upon termination, your right to use the Service ceases immediately. Any subscription fees already paid are non-refundable in the event of termination. We may, at our discretion, remove any content associated with your account.

11. Limitation of Liability

In no event shall Machicrate, its owners, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to: loss of data, loss of revenue, loss of business opportunities, plugin corruption, or service interruptions, arising from your use of or inability to use the Service.

Machicrate is not responsible for any actions taken by TheoTown or Blueflower GbR regarding plugins created using our platform, including but not limited to the removal of plugins from TheoTown's official store or changes to TheoTown's EULA that may affect plugin compatibility.

12. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. When we make material changes, we will notify you by posting the updated Terms on this page and updating the "Effective Date" above. We may also notify you via email or through the platform.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service and close your account.

13. Contact Us
